    The Department of Commerce (Commerce) is partially rescinding its administrative review of the antidumping duty order on certain hardwood plywood products (hardwood plywood) from the People's Republic of China (China) for the period June 23, 2017 through December 31, 2018.

    SUPPLEMENTARY INFORMATION:

    Background

    On February 8, 2019, Commerce published in the Federal Register a notice of opportunity to request an administrative review of the antidumping duty (AD) order on hardwood plywood from China for the period of review (POR) June 23, 2017, through December 31, 2018.[1] Pursuant to requests from interested parties, Commerce initiated an administrative review with respect to 58 companies in accordance with section 751(a) of the Tariff Act of 1930, as amended (the Act).[2] Subsequent to the initiation of the administrative review, several interested parties timely withdrew their request for 29 of these companies, as discussed below. No other party requested an administrative review of these companies.

    Partial Rescission of Administrative Review

    Pursuant to 19 CFR 351.213(d)(1), Commerce will rescind an administrative review, in whole or in part, if the party that requested the review withdraws its request within 90 days of the publication of the notice of initiation. The request for an administrative review of the following companies was withdrawn within 90 days of the date of publication of the Initiation Notice: Celtic Co., Ltd.; [3] Feixian Longteng Wood Co., Ltd.; [4] Golder International Trade Co., Ltd.; [5] Highland Industries-Hanlin.; [6] Huainan Mengping Import and Export Co., Ltd.; [7] Jiangsu Top Point International Co., Ltd.; [8] Jiaxing Gsun Imp. & Exp. Co., Ltd.; [9] Lianyungang Yuantai International Trade Co., Ltd. (Yuantai); [10] Linyi City Dongfang Jinxin Economic and Trade Co., Ltd. As a result, pursuant to 19 CFR 351.213(d)(1), Commerce is rescinding the administrative review of the AD order on certain hardwood plywood products with respect to these 29 companies. The instant review will continue with respect to the remaining companies for which a review was initiated on.

    Assessment

    Commerce will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties on all appropriate entries. For the companies for which this review is rescinded, antidumping duties shall be assessed at rates equal to the cash deposit of estimated antidumping duties required at the time of entry, or withdrawal from warehouse for consumption, in accordance with 19 CFR 351.212(c)(l)(i). Commerce intends to issue appropriate assessment instruction to CBP 15 days after publication of this notice in the Federal Register, if appropriate.

    Notification to Importers

    This notice serves as a final reminder to importers of their responsibility under 19 CFR 351.402(f)(2) to file a certificate regarding the reimbursement of any antidumping or countervailing duties prior to liquidation of the relevant entries during this review period. Failure to comply with this requirement could result in the presumption that reimbursement of any antidumping or countervailing duties occurred and the subsequent assessment of doubled antidumping duties.

    Notification Regarding Administrative Protective Orders

    This notice also serves as a final reminder to parties subject to administrative protective order (APO) of their responsibility concerning the disposition of proprietary information disclosed under APO in accordance with 19 CFR 351.305(a)(3), which continues to govern business proprietary information in this segment of the proceeding. Timely written notification of the return or destruction of APO materials, or conversion to judicial protective order, is hereby requested. Failure to comply with the regulations and terms of an APO is a violation which is subject to sanction. This notice is issued and published in accordance with sections 751(a)(1) and 777(i)(1) of the Tariff Act of 1930, as amended, and 19 CFR 351.213(d)(4).
