§ 102-3.5 What does this subpart part cover and how does it apply?
This subpart part provides the policy framework and establishes minimum requirements that must be used by agency heads and Federal officers in applying the Federal Advisory Committee Act (FACA), as amended (FACA or “the Act”), 5 U.S.C. chapter 10, App., to advisory committees they establish and operate. In addition to listing key definitions underlying the interpretation of the Act, this subpart part establishes the scope and applicability of the Act , and outlines specific exclusions from its coverage. This part is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person, including any advisory committee or officer, member, employee, agent, or contractor of any advisory committee.
