§ 816.99 What measures must I take to prevent and remediate landslides?Slides and other damage.
(a) You, the permittee or operator, must provide an An undisturbed natural barrier shall be provided beginning at the elevation of the lowest coal seam to be mined and extending from the outslope for the distance that such distance as may be determined by the regulatory authority determines as is needed to assure stability. The barrier must shall be retained in place to prevent slides and erosion.
(b)
(1) You must notify the regulatory authority by the fastest available means whenever a landslide occurs that has the potential to adversely affectAt any time a slide occurs which may have a potential adverse affect on public property, health, safety, or the environment
. (2) You must, the person who conducts the surface mining activities shall notify the regulatory authority by the fastest available means and comply with any remedial measures
