§ 817.131 - Cessation of operations: Temporary.

§ 817.131 What actions must I take when I temporarily cease mining operations?Cessation of operations: Temporary.
(a)
(1)Each person who
temporarily ceases to conductconducts underground mining activities
at a particular site mustshall effectively support and maintain all surface access openings to underground operations, and secure surface facilities in areas in which there are no current operations, but
whereoperations are to be resumed under an approved permit.
(2) Temporary cessation doesTemporary abandonment shall not relieve a person of his or her obligation to comply with any provisions of the approved permit.
(b)
(1) You must submit a notice of intent to temporarily cease operations to the regulatory authority before ceasingBefore temporary cessation of mining and reclamation operations for
30a period of thirty days or more
days, or as soon as
you knowit is known that a temporary cessation will extend beyond 30 days
. (2) The notice of temporary cessation must, each person who conducts underground mining activities shall submit to the regulatory authority a notice of intention to cease or abandon operations. This notice shall include a statement of the
- (i) Exactexact number of surface acres
disturbed within theand the horizontal and vertical extent of sub-surface strata which have been in the permit area prior to
temporary cessation; (ii) Extentcessation or abandonment, the extent and kind of reclamation
accomplished before temporary cessation; and (iii) Backfillingof surface area which will have been accomplished, and identification of the backfilling, regrading, revegetation, environmental monitoring, underground opening closures
,and water treatment activities that will continue during the temporary cessation.
