§ 2803.104-5 - Disclosure, protection, and marking of proprietary and source selection information.

  • (a) The head of the agency, or his or her designee, or the contracting officer are permitted by FAR 3.104-5(d) to authorize persons, or classes of persons, access to proprietary or source selection information when access is necessary to the conduct of the procurement. Authorizations to individuals should be made in writing only after confirmation by the contracting officer that the individual has completed a certification in accordance with FAR 3.104-12(a)(2). Authorizations to classes of persons must be made at a level not lower than the chief of the contracting office.

    (b) The head of the office receiving the proprietary or source selection information, or his or her designee, shall maintain a list of persons, or classes of persons, who have authorized access to the information. The list shall be forwarded to the contracting office responsible for the conduct of the procurement to be included in the contract file.
