§ 2825.302-70 - Policy.

The agency officials authorized to make determinations under FAR 25.302(b)(3), as well as authorize the use of a differential greater than 50 percent for the evaluation of domestic and foreign offers under the Balance of Payments Program, are those officials listed in 2801.601(a) or their designees. All determinations made under this part shall be in writing and shall set forth the facts and circumstances supporting the determination. Determinations shall be reviewed and concurred in by the contracting activity's procurement counsel. Authorizations to use a differential greater than 50 percent for the evaluation of domestic and foreign offers under the Balance of Payments Program (ref. FAR 25.302(c) and 25.303(b)) shall also require a written determination.
