§ 218.143 Prohibitions.
an LOA(a) Notwithstanding incidental takings contemplated in § 218.142(a) and authorized by
147 of this chapterLOAs issued under §§ 216.106 of this chapter and 218.
described146, no person in connection with the activities
blisted in § 218.140(c) may:
a)(
1) Violate, or fail to comply with, the terms, conditions, and requirements of this subpart or an LOA issued under §§ 216.106 of this chapter and 218.146;
c(2) Take any marine mammal not specified in § 218.142(
b);
(
c3) Take any marine mammal specified in § 218.142(
by incidental takeb) in any manner other than
§ 218.142(c); (cas specified in
cthe LOAs; or
(4) Take a marine mammal specified in § 218.142(
stocksb) if NMFS determines such taking results in more than a negligible impact on the species or
; orstock of such marine mammal
.
d) Violate, or fail to comply with, the terms, conditions, and requirements of these regulations or an LOA issued under §§ 216.106 and 218.147.(
