§ 218.143 Prohibitions.

(a) Notwithstanding incidental takings contemplated in § 218.142(a) and authorized by

an LOA

LOAs issued under §§ 216.106 of this chapter and 218.

147 of this chapter

146, no person in connection with the activities

described

listed in § 218.140(c) may:

(

a)

1) Violate, or fail to comply with, the terms, conditions, and requirements of this subpart or an LOA issued under §§ 216.106 of this chapter and 218.146;

(2) Take any marine mammal not specified in § 218.142(

c

b);

(

b

3) Take any marine mammal specified in § 218.142(

c

b) in any manner other than

by incidental take

as specified in

§ 218.142(c); (c

the LOAs; or

(4) Take a marine mammal specified in § 218.142(

c

b) if NMFS determines such taking results in more than a negligible impact on the species or

stocks

stock of such marine mammal

; or

d) Violate, or fail to comply with, the terms, conditions, and requirements of these regulations or an LOA issued under §§ 216.106 and 218.147.
