  • § 1484.71 Are Cooperator documents subject to the provisions of the Freedom of Information Act?Disclosure of program information.

    (a) Documents submitted to FAS CCC by Cooperators are subject to the provisions of the Freedom of Information Act (FOIA), 5 U.S.C. 552, 7 CFR part 1, Subpart subpart A - Official Records, and, specifically, 7 CFR 1.11 - Handling Information from a Private Business12.

    (b) If requested by a person located in the United States Upon request, a Cooperator shall provide to such any person a copy of any document in its possession or control containing market information that is developed and produced under the terms of its agreement. The Cooperator may charge a fee not to exceed the costs for assembling, duplicating, and distributing the materials.

    (c) The results of any Any research conducted by a Cooperator under pursuant to an agreement and/or approval letter shall be subject to the property of the U.S. Government. provisions relating to intangible property in 2 CFR part 200.
