    Wisconsin Electric Power Company; Point Beach Nuclear Power 
    Plant, Unit Nos. 1 and 2; Denial of Amendment to Facility Operating 
    License and Opportunity for Hearing
    
    [Docket Nos. 50-266 and 50-301]
        The U.S. Nuclear Regulatory Commission (the Commission) has denied 
    a request by Wisconsin Electric Power Company, the licensee, for an 
    amendment to Facility Operating Licenses DPR-24 and DPR-27 issued to 
    the licensee for operation of the Point Beach Nuclear Plant, Units 1 
    and 2, respectively, located in Two Creeks, Wisconsin. Notice of 
    Consideration of Issuance of Amendment to Facility Operating Licensee 
    and Opportunity for a Hearing was published in the Federal Register on 
    September 16, 1994 (59 FR 47656).
        The licensee submitted the amendment request to revise Technical 
    Specification (TS) Section 15.4.2, ``In-Service Inspection of Safety 
    Class Components,'' by incorporating acceptance criteria to allow steam 
    generator sleeved tubes with certain upper sleeve parent tube 
    indications to remain in service as described in Westinghouse Electric 
    Corporation's report WCAP-14157, ``Technical Evaluation of Hybrid 
    Expansion Joint (HEJ) Sleeved Tubes With Indications Within the Upper 
    Joint Zone.''
        The NRC staff has concluded that the licensee's request cannot be 
    granted because, based on available data, uncertainties in: the 
    potential locations of cracking; crack growth rates; allowable maximum 
    crack size; potential leakage rates; and the probability of detection 
    of cracks are too great to demonstrate that licensing basis criteria 
    would be satisfied for all normal and postulated accident conditions. 
    The licensee was notified of the Commission's denial of the proposed 
    change in a letter of
        By February 17, 1995, the licensee may demand a hearing with 
    respect to the denial described above. Any person whose interest may be 
    affected by this proceeding may file a written petition for leave to 
    intervene.
        A request for hearing or petition for leave to intervene must be 
    filed with the Secretary of the Commission, U.S. Nuclear Regulatory 
    Commission, Washington, DC 20555-0001, Attention: Docketing and 
    Services Branch, or may be delivered to the Commission's Public 
    Document Room, the Gelman Building, 2120 L Street, NW., Washington, DC, 
    by the above date.
        A copy of any petition should also be sent to the Office of the 
    General Counsel, U.S. Nuclear Regulatory Commission, Washington, DC 
    20555, and to Gerald Charnoff, Esq., Shaw, Pittman, Potts, and 
    Trowbridge, 2300 N Street, NW., Washington, DC 20037, attorney for the 
    licensee.
