Notice of Lodging of Consent Decree Pursuant to the Resource
Conservation and Recovery Act of 1976
In accordance with Departmental police, 28 CFR 50.7, notice is
hereby given that a proposed consent decree in United States v. USX
Corporation, Civil Action No. CV-97-G-3188-S was lodged on December 11,
1997, with the United States District Court for the Northern District
of Alabama. USX Corporation owns and operates an integrated steel mill
located in Birmingham, Alabama. This action for civil penalties and
injunctive relief under Section 3008 (a) and (g) of the Resource
Conservation and Recovery Act (RCRA), 42 U.S.C. 6928 (a) and (g), was
filed against USX on December 11, 1997. The complaint alleged
violations of RCRA Sections 3004 and 3005, 42 U.S.C. 6924 and 6925, and
the implementing regulations. USX has agreed to pay a civil penalty in
the amount of $1 million. Also, USX has agreed to perform two
Supplemental Environmental Projects (SEPs) at the U.S. Steel facility
in Birmingham, Alabama, at a cost to USX of not less than $1,750,000.
In addition, USX has agreed to manage, store and dispose of a spent
flush solvent waste generated at the U.S. Steel facility as a hazardous
waste and to cease disposing of the spent flush solvent at the Exum
Landfill at the U.S. Steel facility; it has agreed to secure and
restrict access to the Exum Landfill; and it has agreed to perform
corrective action at the facility pursuant to Section 3008(h) of RCRA,
42 U.S.C. 6928(h).
The Department of Justice will receive, for a period of 30 days
from the date of this publication, comments relating to the proposed
consent decree. Comments should be addressed to the Assistant Attorney
