In accordance with part 211 of Title 49 Code of Federal Regulations (CFR), notice is hereby given that the Federal Railroad Administration (FRA) has received a request for a waiver of compliance from certain requirements of its safety standards. The individual petition is described below, including the party seeking relief, the regulatory provisions involved, the nature of the relief being requested, and the petitioner's arguments in favor of relief.
Orange Empire Railway Museum
The Orange Empire Railway Museum (OERM) seeks a waiver of compliance from certain provisions of 49 CFR part 232, Brake System Safety Standards for Freight and Other Non-Passenger Trains and Equipment. Specifically, OERM seeks a waiver from the requirements of Appendix B to 49 CFR part 232 for passenger car maintenance requirements. See also 49 CFR 232.17(b)(2).
OERM is a non-profit corporation that operates a historical and excursion train known as the Southern California Railway Museum, Inc. on its own tracks as a Non-insular Tourist Railway. Occasionally, OERM operates off of its line and onto the San Jacinto Industrial Spur for approximately 1/4 mile in order to reach the Historic Perris Depot. As the San Jacinto Industrial Spur is part of the general system of transportation, compliance with part 232 is required. Because of the expense, mileage, low speed operation, and frequency of use of the four passenger cars for which relief is requested, OERM is requesting a 5-year waiver and increased time cycle for the servicing of the brake valves attached to these passenger cars.
Interested parties are invited to participate in these proceedings by submitting written views, data, or comments. FRA does not anticipate scheduling a public hearing in connection with these proceedings since the facts do not appear to warrant a hearing. If any interested party desires an opportunity for oral comment, they should notify FRA, in writing, before the end of the comment period and specify the basis for their request.
