    CSX Transportation, Inc.--Trackage Rights Exemption--Norfolk 
    Southern Railway Company
    
        The Norfolk Southern Railway Company (NS) has agreed to grant 
    approximately 110.2 miles of overhead trackage rights to CSX 
    Transportation, Inc. (CSXT).1 The trackage rights extend from NS 
    milepost 132.4A at West Knoxville, TN, to the connection between NS and 
    CSXT at NS milepost 242.6A at Chattanooga, TN. The trackage rights were 
    to become effective on October 3, 1994.

        \1\ The trackage rights are limited to the movement of one train 
    daily in each direction as part of the through movement of coal 
    traffic by CSXT to the Widow's Creek Steam Power Plant of the 
    Tennessee Valley Authority at Bridgeport, AL.

        This notice is filed under 49 CFR 1180.2(d)(7). If the notice 
    contains false or misleading information, the exemption is void ab 
    initio. Petitions to revoke the exemption under 49 U.S.C. 10505(d) may 
    be filed at any time. The filing of a petition to revoke will not stay 
    the transaction. Pleadings must be filed with the Commission and served 
    on: John W. Humes, Jr., CSX Transportation, Inc., 500 Water Street, 
    Jacksonville, FL 32202.
        As a condition to the use of this exemption, any employees 
    adversely affected by the trackage rights will be protected under 
    Norfolk and Western Ry. Co.--Trackage Rights--BN, 354 I.C.C. 605 
    (1978), as modified in Mendocino Coast Ry., Inc.--Lease and Operate, 
    360 I.C.C. 653 (1980).
