Notice of Lodging of Settlement Stipulation Pursuant to the Clean
Air Act
Under 28 CFR 50.7, notice is hereby given that a proposed
Stipulation and Order for Dismissal in United States v. State of
Wisconsin Inc., Civ. No. 98-C-0517-C., was lodged with the United
States District Court for the Western District of Wisconsin, on
September 27, 1999. That action was brought against defendant pursuant
to sections 112 and 113 of the Clean Air Act (``the Act''), 42 U.S.C.
7412, 7413, and associated regulations, for violations occurring at the
University of Wisconsin, Madison campus. Specifically, the amended
compliant alleged that defendant violated the Act and the National
Emission Standards for Hazardous Air Pollutants for asbestos, 40 CFR
Part 61, subpart M, by failing to keep adequately wet and properly
dispose of asbestos-containing material during a renovation of two
buildings on the campus. The settlement stipulation requires defendant
to pay $36,000 to resolve the claims alleged in the complaint.
The Department of Justice will receive comments relating to the
proposed settlement stipulation for a period of 30 days from the date
of this publication. Comments should be addressed to the Assistant
Attorney General of the Environment and Natural Resources Division,
Department of Justice, Washington, DC 20530. All comments should refer
to United States v. State of Wisconsin, D.J. Ref. 90-5-2-1-2106.
The proposed settlement stipulation may be examined at the office
of the United States Attorney for the Western District of Wisconsin,
660 West Washington Avenue, Madison, Wisconsin 53701-1585; and at the
Region V office of the Environmental Protection Agency, 77 West Jackson
Blvd., Chicago, Illinois 60604. A copy of the proposed stipulation may
also be obtained by mail from the Department of Justice Consent Decree
Library, P.O. Box 7611, Washington, DC. 20044. In requesting a copy,
please enclose a check in the amount of $2.75 for the stipulation (25
cents per page reproduction costs) payable to the Consent Decree
Library. When requesting a copy, please refer to the United States v.
State of Wisconsin, D.J. Ref. 90-5-2-1-2106.
