Office of Arms Control and Nonproliferation Policy; Proposed
    Subsequent Arrangement

    AGENCY: Department of Energy.

    ACTION: Subsequent arrangement.

    -----------------------------------------------------------------------

SUMMARY: This notice is being issued under the authority of Section 131
of the Atomic Energy Act of 1954, as amended (42 U.S.C. 2160). The
Department is providing a notice of a proposed ``subsequent
arrangement'' under the Agreement for Cooperation in the Peaceful Uses
of Nuclear Energy Between the United States of America and the European
Atomic Energy Community (EURATOM) and the Agreement for Cooperation
Between the Government of the United States of America and the
Government of the People's Republic of China Concerning the Peaceful
    Uses of Nuclear Energy.
The subsequent arrangement concerns approval of RTD/PC(EU)-1 for
the retransfer of 32,574 grams of slightly irradiated fuel spheres
containing 5,456.145 grams of the isotope U-235 (16.76 percent
enrichment) from EURATOM (Germany) to the People's Republic of China
for use as research material in the 10 megawatt High Temperature Gas-
cooled Reactor (HTR-10) which is being constructed at the Institute of
Nuclear Energy Technology (INET) in Beijing, China.
The material was originally transferred from Germany to Switzerland
as RTD/SD(EU)-59 for fabrication into graphite coated fuel spheres and
    returned to Germany as RTD/EU(SD)-1.
In accordance with Section 131 of the Atomic Energy Act of 1954, as
amended, it has been determined that this subsequent arrangement will
not be inimical to the common defense and security.
This subsequent arrangement will take effect no sooner than fifteen
days after the date of publication of this notice.

        Dated: October 8, 1999.
