Drawbridge Operation Regulations; Coquille River, OR
AGENCY: Coast Guard, DOT.
ACTION: Final rule.

SUMMARY: This amendment removes the operating regulations for the
drawbridge across the Coquille River, mile 24.0, at Coquille, Oregon.
This bridge formerly served a secondary highway but has been removed in
its entirety. Notice and public procedure have been omitted from this
action because the bridge no longer exists.
EFFECTIVE DATE: October 18, 1994.

SUPPLEMENTARY INFORMATION: In accordance with 5 U.S.C. 553, a notice of
proposed rulemaking was not published for this regulation change and
good cause exists for making it effective in less than 30 days after
publication in the Federal Register. The drawbridge to which these
regulations applies no longer exists and removal of these regulations
from the Code of Federal Regulations is the only action being
considered by the Coast Guard. Therefore, notice and public procedure
thereof are impracticable, unnecessary, and contrary to the public
interest.

Regulatory Evaluation
This action is not a significant regulatory action under 3(f) of
Executive Order 12866 and does not require an assessment of potential
cost and benefits under section 6(a)(3) of that order. It has been
exempted from review by the Office of Management and Budget under that
order. It is not significant under the regulatory policies and
procedures of the Department of Transportation (DOT) (44 FR 11040;
February 26, 1979). The Coast Guard expects the economic impact of this
final rule to be so minimal that a full regulatory evaluation under
paragraph 10e of the regulatory policies and procedures of DOT is
unnecessary.
Small Entities
Under the Regulatory Flexibility Act (5 U.S.C. 601 et seq.), the
Coast Guard must consider whether this action will have a significant
effect on a substantial number of small entities. ``Small entities''
include independently owned and operated small businesses that are not
dominant in their field and that otherwise qualify as ``small business
concerns'' under section 3 of the Small Business Act (15 U.S.C. 632).
Therefore, the Coast Guard certifies under 5 U.S.C. 605(b) that this
action will not have a significant impact on a significant number of
small entities.
Collection of Information
This action contains no collection of information requirements
under the Paperwork Reduction Act (44 U.S.C. 3501 et seq.).
Federalism
This action has been analyzed in accordance with the principles and
criteria contained in Executive Order 12612, and it has been determined
that this rulemaking does not have sufficient federalism implications
to warrant the preparation of a Federalism Assessment.
Environment
The Coast Guard has reviewed the environmental impact of this
action and concluded under section 2.B.2. of the NEPA Implementing
Procedures, COMDTINST M16475.B that the action is categorically
excluded from further environmental documentation because promulgation
of changes to drawbridge regulations have been found not to have a
significant effect on the human environment. The drawbridge that this
amendment applies to no longer exists. A Categorical Exclusion
Determination is available in the docket for inspection or copying.

In consideration of the foregoing, the Coast Guard amends part 117
of title 33, Code of Federal Regulations as follows:
PART 117--DRAWBRIDGE OPERATION REGULATIONS
1. The authority citation for part 117 continues to read as
follows:
Authority: 33 U.S.C. 499; 49 CFR 1.46; 33 CFR 1.05-1(g).
2. Section 117.875 is revised to read as follows:
Sec. 117.875 Coquille River.
The draws of the US 101 highway bridge, mile 3.5 at Bandon, Oregon,
shall open on signal if at least two hours notice is given to the
drawtender at the Coos Bay South Slough bridge.
