2014-24756. Petition for Waiver of Compliance

    In accordance with Part 211 of Title 49 Code of Federal Regulations (CFR), this document provides the public notice that by a document dated July 24, 2014, Grand Canyon Railway (GCR) petitioned the Federal Railroad Administration (FRA) for a waiver of compliance from certain provisions of the Federal railroad safety regulations contained at 49 CFR Part 229, Railroad Locomotive Safety Standards. FRA assigned the petition Docket Number FRA-2014-0074.

    Specifically, GCR petitioned for a waiver of compliance from 49 CFR 229.140, Alerters, which requires all controlling locomotives operating at speeds greater than 25 mph to be equipped with a functioning alerter effective January 1, 2017. GCR currently has five locomotives that would fall under this regulation. GCR cites the cost of equipping the locomotives with alerters, the fact that they operate with two crew members in the operating cab per Arizona State law, and its 25-year record of no reportable accidents attributable to nonvigilant crew members as justification for this relief.

FRA does not anticipate scheduling a public hearing in connection with these proceedings since the facts do not appear to warrant a hearing. If any interested party desires an opportunity for oral comment, they should notify FRA, in writing, before the end of the comment period and specify the basis for their request.
