f. Location: The proposed project would be located on Kinderhook Creek in Columbia County, New York.

l. Description of Project: The proposed project would consist of: (1) An existing 240-foot-long, 13-foot-high, Masonry gravity dam, (2) an existing impoundment, with a surface area of 46 acres and negligible storage at normal water surface elevation 174.3 feet USGS, (3) a proposed 3,250-foot-long, 10-foot-diameter steel pipe, (4) an existing 25-foot-diameter surge tank, (5) an existing powerhouse containing 2 new and 1 upgraded generating units having a total installed capacity of 11,100 KW, and (6) appurtenant facilities. The project would have an average annual generation of 14.86 gigawatt hours.

o. Competing Applications—Public notice of the filing of the initial preliminary permit application, which has already been given, established the due date for filing competing preliminary permit applications or notices of intent. Any competing preliminary permit or development application or notice of intent to file a competing preliminary permit or development application must be filed in response to and in compliance with the public notice of the initial preliminary permit application. No competing applications or notices of intent to file competing applications may be filed in response to this notice. A competing license application must conform with 18 CFR 4.30 (b) and 4.36.

p. Proposed Scope of Studies under Permit—A preliminary permit, if issued, does not authorize construction. The term of the proposed preliminary permit would be 36 months. The work proposed under the preliminary permit would include economic analysis, preparation of preliminary engineering plans, and a study of environmental impacts. Based on the results of these studies, the Applicant would decide whether to proceed with the preparation of a development application to construct and operate the project.

q. Comments, Protests, or Motions to Intervene—Anyone may submit comments, a protest, or a motion to intervene in accordance with the requirements of Rules of Practice and Procedure, 18 CFR 385.210, .211, .214. In determining the appropriate action to take, the Commission will consider all protests or other comments filed, but only those who file a motion to intervene in accordance with the Commission's Rules may become a party to the proceeding. Any comments, protests, or motions to intervene must be received on or before the specified comment date for the particular application.

r. Filing and Service of Responsive Documents—Any filings must bear in all capital letters the title “COMMENTS”, “PROTEST”, or “MOTION TO INTERVENE”, as applicable, and the Project Number of the particular application to which the filing refers.
