Proposed Prospective Purchaser Agreement Pursuant to the
Comprehensive Environmental Response, Compensation and Liability Act of
1980, as Amended by the Superfund Amendments and Reauthorization Act,
Bonne Terre Superfund Site, St. Francois County, MO
AGENCY: Environmental Protection Agency (EPA).
ACTION: Notice; request for public comment.

SUMMARY: Notice is hereby given that a proposed prospective purchaser
agreement associated with the Bonne Terre Superfund Site, located in
St. Francois County, Missouri, was executed by the Agency on June 24,
1998, and concurred upon by the United States Department of Justice on
September 10, 1998. This agreement is subject to final approval after
the comment period. The Prospective Purchaser Agreement would resolve
certain potential EPA claims under the Comprehensive Environmental
Response, Compensation and Liability Act of 1980, as amended by the
Superfund Amendments and Reauthorization Act of 1986 (``CERCLA''),
against the City of Bonne Terre, Missouri, the prospective purchasers
(``the purchasers'').
The settlement would require the purchasers to eliminate any threat
of direct exposure to the mine tailings by providing and maintaining a
permanent clean cover over the entire property; level and grade the
property so as to minimize the potential for erosion; agree to deed
restrictions prohibiting residential use of the property or any other
use that might attract children; properly handle any excavation of
highly contaminated soils; and provide the EPA access to the Site.
For thirty (30) days following the date of publication of this
document, the Agency will receive written comments relating to the
proposed settlement.
DATES: Comments must be submitted on or before November 5, 1998.
