MATTERS TO BE CONSIDERED: The Commission will hear oral argument on the
following:
1. Secretary of Labor v. Arch of Kentucky, Docket No. KENT 97-197
(Issues include whether the Judge erred in determining that the
operator violated 30 CFR Sec. 75.1403-6(b)(3)'s requirement that each
track-mounted self-propelled personnel carrier be equipped with
properly installed and well-maintained sanding devices, and that the
violation was significant and substantial.)
