Notice of Lodging of Consent Decree Pursuant to Comprehensive
Environmental Response, Compensation, and Liability Act
Notice is hereby given that on November 6, 1998, a proposed consent
decree in United States v. Compaction Systems Corporation, et al.,
Civil Action No. 96-5349, was lodged with the United States District
Court for the District of New Jersey.
In this action, the United States alleged, inter alia, that under
section 107 of the Comprehensive Environmental Response, Compensation,
and Liability Act (CERCLA), 42 U.S.C. 9607, the defendants were liable
for the federal government's costs in responding to the release or
threatened release of hazardous substances at the Combe Fill North
Landfill Superfund Site in Mount Olive, Morris Township, New Jersey
(the Site). The proposed consent decree resolves the United States'
claim for past response costs against the defendants and third-party
defendants named in this action, including, among others, Occidental
Chemical Corporation, Connecticut Resource Recovery Authority,
Rayonier, Inc., Knoll Pharmaceuticals, Inc., and Browning-Ferris
Industries of North Jersey, Inc. (A complete list of current settling
parties is contained in the proposed decree; during the period of
public comment, other parties may be added to that list.) Under the
terms of the proposed consent decree, the settling parties will pay the
United States the sum of $7.5 million in reimbursement of past response
costs with respect to the Site.
The Department of Justice will receive for a period of thirty (30)
days from the date of this publication comments relating to the
proposed partial consent decree. Comments should be addressed to the
Assistant Attorney General of the Environment and Natural Resources
Division, Department of Justice,

Washington, DC 20530, and should refer to United States v. Compaction
Systems Corporation, et al., Civil Action No. 99-5349, D.J. Ref. 90-11-
2-1134.
The proposed consent decree may be examined at the Office of the
United States Attorney, District of New Jersey, 970 Broad Street,
Newark, New Jersey 07102, at U.S. Environmental Protection Agency
Region II, 290 Broadway, New York, New York 10007-1866, and at the
Consent Decree Library, 1120 G Street, NW, 3rd Floor, Washington, DC
20005. A copy of the proposed consent decree may be obtained in person
or by mail from the Consent Decree Library, 1120 G Street, NW, 4th
Floor, Washington, DC 20005. In requesting a copy, please enclose a
check in the amount of $17.25 (25 cent per page reproduction cost).
