Notice of Lodging of Settlement Agreement Pursuant to the
Comprehensive Environmental Response Compensation and Liability Act, 42
U.S.C. Sec. 9601 et seq. (``CERCLA'')
In accordance with Departmental policy, 28 C.F.R. Sec. 50.7, and 42
U.S.C. Sec. 9622(d), notice is hereby given that a consent decree in
United States v. Linemaster Switch Corporation, 3-94-0170, was lodged
with the United States District Court for the District of Connecticut,
on October 11, 1994.
The consent decree resolves claims for past and future costs and
implementation of response actions sought in an action brought by the
United States against defendant Linemaster Switch Corporation
(``Linemaster''), under Sections 106 and 107 of the Comprehensive
Environmental Response, Compensation and Liability Act (``CERCLA''), 42
U.S.C. Secs. 9606 and 9607, relating to the Linemaster Superfund Site
(``Site''), located in Woodstock, Windham County, Connecticut. Under
the proposed settlement, Linemaster will perform the remedy for the
Site and reimburse the United States for its past and future costs.
The Department of Justice will receive, for a period of thirty (30)
days from the date of this publication, comments relating to the
proposed consent decree. Comments should be addressed to the Assistant
Attorney General for the Environment and Natural Resources Division,
Department of Justice, Washington, DC 20530, and should refer to United
States v. Linemaster Switch Corporation, DOJ Ref. # 90-11-3-878A.
The proposed consent decree may be examined at the United States
Attorney's Office for the District of Connecticut, 157 Church Street,
23rd Flr, New Haven, CT 06508; the Region I Office of the Environmental
Protection Agency, J.F. Kennedy Federal Building, Boston, MA 02203-
2211; and at the Consent Decree Library, 1120 G Street, NW., 4th Floor,
Washington, DC 20005, (202) 624-0892. A copy of the proposed consent
decree may be obtained in person or by mail from the Consent Decree
Library, 1120 G Street, NW., 4th Floor, Washington, DC 20005. In
requesting a copy please refer to the referenced case and enclose a
check in the amount of $25.25 (25 cents per page reproduction costs),
payable to the Consent Decree Library.
