    AGENCY: U.S. International Trade Commission.
    
    ACTION: Notice.

    SUMMARY: Notice is hereby given that the Commission has determined not 
    to review the presiding administrative law judge's (ALJ's) initial 
    determination (ID) in the above-captioned investigation terminating the 
    investigation on the basis of a settlement agreement.

    SUPPLEMENTARY INFORMATION: This patent-based section 337 investigation 
    was instituted by the Commission on April 25, 1996, on behalf of Patton 
    Electronics Co. (Patton) of Gaithersburg, Maryland. The complaint 
    alleges violations of section 337 based on the importation into the 
    United States, the sale for importation, and the sale within the United 
    States after importation of certain self-powered fiber optic modems 
    that allegedly infringe claims 1, 2, 3, 7, and 8 of U.S. Letters Patent 
    4,161,650, (the `650 patent) and that there exists an industry in the 
    United States as required by subsection (a)(2) of section 337. The 
    notice of investigation named RAD Data Communications, Ltd., of Tel 
    Aviv, Israel and RAD Data Communications, Inc. (collectively ``RAD'') 
    of Mahwah, New Jersey as respondents.
        On October 11, 1996, Patton and RAD filed a joint motion to 
    terminate the investigation based on a settlement agreement. On October 
    23, 1996, the Commission investigative attorney (IA) filed a response 
    in support of the joint motion to terminate the investigation. On 
    October 24, 1996, the ALJ issued an ID (Order No. 16) granting the 
    joint motion to terminate the investigation on the basis of a 
    settlement agreement. No petitions for review of the ID were filed.
        This action is taken under the authority of section 337 of the 
    Tariff Act of 1930, 19 U.S.C. 1337, and Commission rule 210.42, 19 
    C.F.R. 210.42.
        Copies of the ALJ's ID and all other nonconfidential documents 
    filed in connection with this investigation are or will be available 
    for inspection during official business hours (8:45 a.m. to 5:15 p.m.) 
    in the Office of the Secretary, U.S. International Trade Commission, 
    500 E Street S.W., Washington, D.C. 20436, telephone 202-205-2000.
