    Public Land Order No. 7297; Partial Revocation of Two Executive 
    Orders and Two Secretarial Orders; Colorado
    
    AGENCY: Bureau of Land Management, Interior.
    
    ACTION: Public Land Order.

    SUMMARY: This order partially revokes two Executive orders and two 
    Secretarial orders insofar as they affect 322.62 acres of public lands 
    withdrawn for waterpower purposes. These lands no longer have value for 
    waterpower. The withdrawals will be revoked and the lands opened to 
    disposal to allow for an exchange. The lands have been open to mining 
    under the provisions of the Mining Claims Rights Restoration Act of 
    1955, and these provisions are no longer required. The lands have been 
    and will remain open to mineral leasing.
    
    EFFECTIVE DATE: February 27, 1998.

        By virtue of the authority vested in the Secretary of the Interior 
    by Section 204 of the Federal Land Policy and Management Act of 1976, 
    43 U.S.C. 1714 (1994), it is ordered as follows:
        1. The Executive Order dated May 27, 1913, which established Power 
    Site Reserve No. 356, the Executive Order dated March 25, 1919, which 
    established Power Site Reserve No. 715, the Secretarial Order dated 
    September 14, 1943, which established Power Site Reserve No. 343, and 
    the Secretarial Order dated August 12, 1937, which established Power 
    Site Reserve No. 367, are hereby revoked insofar as they affect the 
    following described public lands:
    
    Sixth Principal Meridian
    
    T. 2 N., R. 71 W.,
        Sec. 26, lots 3 and 4.
    T. 3 N., R. 71 W.,
        Sec. 11, SE\1/4\SW\1/4\ and SE\1/4\SE\1/4\;
        Sec. 13, lot 3;
        Sec. 14, lots 1, 6, and 7.
    
        The areas described aggregate 322.62 acres in Boulder County.
    
        2. At 9 a.m. on February 27, 1998, the lands will be opened to the 
    operation of the public land laws generally, subject to valid existing 
    rights, the provisions of existing withdrawals, other segregations of 
    record, and the requirements of applicable law. All valid applications 
    received at or prior to 9 a.m. on February 27, 1998, shall be 
    considered as simultaneously filed at that time. Those received 
    thereafter shall be considered in the order of filing.
        3. The lands have been open to mining under the provisions of the 
    Mining Claims Rights Restoration Act of 1955, 30 U.S.C. 621 (1994). 
    However, since this act applies only to lands withdrawn for power 
    purposes, the provisions of the act are no longer applicable. The lands 
    have been and will remain open to mineral leasing.
        4. The State of Colorado, with respect to the lands described in 
    paragraph 1, has a preference right for public highway rights-of-way or 
    material sites for a period of 90 days from the date of publication of 
    this order and any location, entry, selection, or subsequent

    patent shall be subject to any rights granted the State as provided by 
    the Act of June 10, 1920, Section 24, as amended, 16 U.S.C. 818 (1994).
