Acid Rain Program: Petition for Administrative Review of 
Determination of Applicability

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

SUMMARY: On October 3, 1996, a petition was filed with the 
Environmental Appeals Board appealing a determination by the 
Administrator of the applicability of the Acid Rain Program to the 
Carson Cogeneration facility in California.

SUPPLEMENTARY INFORMATION: The Carson Energy Group petitioned the 
Administrator under 40 CFR 72.6(c) to make a determination of 
applicability of the Acid Rain Program to the Carson Cogeneration 
facility (``Carson'') located near Sacramento, California. A 
determination was made by the Administrator that Carson is an affected 
source subject to the requirements of the program. The Administrator's 
decision was appealed to the Environmental Appeals Board by the Carson 
Energy Group through a petition filed on October 3, 1996 under part 78 
of the Acid Rain regulations. The petitioner does not believe there are 
any disputed issues of fact and is not requesting an evidentiary 
hearing at this time.
