    Notice of Lodging of Consent Decree Pursuant to the Clean Water 
    Act
    
        In accordance with Departmental Policy, 28 CFR 50.7, notice is 
    hereby given that a proposed Consent Decree in United States v. County 
    of San Luis Obispo, California, Case No. 97-6176 ABC (Ex) (C.D. Cal.), 
    was lodged with the United States District Court for the Central 
    District of California on October 27, 1998. The proposed Decree 
    concerns alleged violations of sections 301(a) and 404 of the Clean 
    Water Act, 33 U.S.C. Secs. 1311(a) and 1344, resulting from Defendant's 
    unauthorized discharge of dredged and/or fill material into waters of 
    the United States at numerous locations within the County of San Luis 
    Obispo during the course of road, culvert and bridge repair 
    construction projects conducted between January 1, 1995 and April 30, 
    1996.
        The proposed Consent Decree would require the payment of a civil 
    penalty of $240,000.
        The United States Department of Justice will receive written 
    comments relating to the proposed Consent Decree for a period of thirty 
    (30) days from the date of publication of this notice. Comments should 
    be addressed to Naikang Tsao, Attorney, United States Department of 
    Justice, Environmental Defense Section, P.O. Box 23986, Washington, 
    D.C. 20026-3986, and should refer to United States v. County of San 
    Luis Obispo, California, Case No. 97-6176 ABC (Ex) (C.D. Cal.).
        The proposed Consent Decree may be examined at the Clerk's Office, 
    United States District Court for the Central District of California, 
    312 North Spring Street, Los Angeles, California 90012.
