Notice of Decision Not To Review an Initial Determination Granting a
Motion for Summary Determination That the Economic Tests for
Establishing a Domestic Industry Are Met
AGENCY: U.S. International Trade Commission.
ACTION: Notice.

SUMMARY: Notice is hereby given that the U.S. International Trade
Commission has determined not to review an initial determination (ID)
(Order No. 9) issued on October 10, 1994, by the presiding
administrative law judge (ALJ) in the above-captioned investigation.
The ID granted a motion of complainant Minnesota Mining and
Manufacturing (3M) for summary determination that the economic tests
for establishing a domestic industry in this investigation are met.

SUPPLEMENTARY INFORMATION: The Commission instituted this
investigation, which concerns allegations of section 337 violations in
the importation, the sale for importation, and the sale within the
United States after importation of certain microsphere adhesives, and
products containing same, including self-stick repositionable notes,
said to infringe eight claims of U.S. Letters Patent 4,166,152, on June
8, 1994 (59 FR 29620).
On August 22, 1994, 3M filed a motion that, inter alia, requested
summary determination that the economic tests for establishing a
domestic industry set forth in section 337(a)(3) (19 U.S.C. 1337(a)(3))
are met in this investigation. That request was opposed by the
respondents to the investigation and supported by the Commission
investigative attorney.
On October 10, 1994, the presiding ALJ issued an ID granting
summary determination that the economic tests for establishing a
domestic industry are met. There were no petitions for review of the ID
and no agency comments were filed.
This action is taken under the authority of section 337 of the
Tariff Act of 1930, 19 U.S.C. 1337, and Commission interim rule 210.53,
19 C.F.R. 210.53.
Copies of the ID and all other nonconfidential documents filed in
connection with this investigation are or will be available for
inspection during official business hours (8:45 a.m. to 5:15 p.m.) in
