f. Location: The project is located on the East Fork of the Tuckasegee River in Jackson County, North Carolina.

k. Description of Request: The licensee is proposing to drawdown the Cedar Cliff Hydroelectric Development's reservoir 30 feet from July 2019 until December 2020 (approximately 17 months) in order to complete auxiliary spillway upgrades for project safety purposes. The auxiliary spillway will be removed, and the spillway area will be modified by rock splitting and blasting to lower the sill to 2,305 ft AMSL to accommodate 6 Fusegates. The resulting spoil material will be placed in the reservoir. The licensee is proposing mitigation measures to protect Indiana bats and northern long-eared bats. The licensee also provided revised Section 401 Water Quality Certification conditions from the North Carolina Division of Water Resources to permit the proposed work. The licensee also included a Water Quality Monitoring Plan to monitor for water quality changes due to pyrite oxidation resulting from exposure of rock during construction and spoil placement in the reservoir. Furthermore, the licensee plans to close the public access boat ramp for the duration of the drawdown, and plans to repave the parking lot and remove sediment from the launch area during the closure.

Comments, Protests, or Motions to Intervene: Anyone may submit comments, a protest, or a motion to intervene in accordance with the requirements of Rules of Practice and Procedure, 18 CFR 385.210, .211, .214. In determining the appropriate action to take, the Commission will consider all protests or other comments filed, but only those who file a motion to intervene in accordance with the Commission's Rules may become a party to the proceeding. Any comments, protests, or motions to intervene must be received on or before the specified comment date for the particular application.
