    Lodging of Consent Decree Pursuant to the Comprehensive 
    Environmental Response, Compensation, and Liability Act and the 
    Resource Conservation and Recovery Act
    
        In accordance with Departmental policy, 28 CFR 50.7, notice is 
    hereby given that a proposed Consent Decree in United States v. CDMG 
    Realty Co, et al., Case No. 89 Civ. 4246 (NHP), was lodged on November 
    30, 1998, in the United States District Court for New Jersey.
        The Consent Decree resolves the United States' claims, pursuant to 
    Sections 106 and 107 of the Comprehensive Environmental Response, 
    Compensation, and Liability Act (``CERCLA''), 42 U.S.C. 9606 and 9607, 
    for response costs incurred, or to be incurred by the United States at 
    the Sharkey Landfill Superfund Site (the ``Site''), located in the 
    Townships of Parsippany-Troy Hills and East Hanover, Morris County, New 
    Jersey. Under the Consent Decree, CDMG Realty Co., a limited 
    partnership that owns a portion of the Site, and the Estate of Helen 
    Ringlieb, representing a former owner of a portion of the Site, will 
    pay the United States $60,000, plus interest on this amount deposited 
    in escrow. Together with a previous settlement entered on December 2, 
    1994, with forty-four defendants who agreed to perform the remediation 
    of the Site, or who cashed-out as de minimis parties, the United States 
    will have recovered $44.360 of the $45.220 million of the total costs 
    associated with the Site.
        The Department of Justice will receive, for a period of thirty (30) 
    days from the date of this publication, comments relating to the 
    proposed Consent Decree. Comments should be addressed to the Assistant 
    Attorney General for the Environment and Natural Resources Division, 
    Department of Justice, Washington, D.C. 20530, and should refer to 
    United States v. CDMG Realty Co., et al., DOJ Ref. #90-11-2-470.
        The proposed Consent Decree may be examined at the Office of the 
    United States Attorney in Newark, New Jersey; the Region II Office of 
    the Environmental Protection Agency, 290 Broadway, New York, New York; 
    and at the Consent Decree Library, 1120 G Street, N.W., 3rd Floor, 
    Washington, D.C. 20005, (202) 624-0892. A copy of the proposed Consent 
    Decree may be obtained in person or by mail from the Consent Decree 
    Library. In requesting a copy, please refer to the referenced case and 
    enclose a check made payable to the Consent Decree Library in the 
    amount of $7.25 (25 cents per page reproduction costs).
