    AGENCY: Environmental Protection Agency (EPA).

    SUMMARY: EPA has authorized its contractor, Eastern Research Group

    (ERG), of Lexington, Massachusetts and it subcontractors Science 
    Applications International Corp (SAIC) of McLean, Virginia, Mathtech 
    (MAT) of Falls Church, Virginia, and ICF Incorporated (ICF) of Fairfax, 
    Virginia, access to information which has been submitted to EPA under 
    sections 4, 5, 6, and 8 of the Toxic Substances Control Act (TSCA). 
    Some of the information may be claimed or determined to be confidential 
    business information (CBI).
    
    DATES: Access to the confidential data submitted to EPA will occur no 
    sooner than December 24, 1996.

    SUPPLEMENTARY INFORMATION: Under contract number 68-W6-0022, contractor 
    ERG, of 110 Hartwell Avenue, Lexington, MA and its subcontractors SAIC, 
    of 1710 Goodridge Drive, McLean VA, MAT of 5111 Leesburg Pike, Falls 
    Church, VA, and ICF of 9300 Lee Highway, Fairfax, VA, will assist the 
    Office of Pollution Prevention and Toxics (OPPT) in evaluating the 
    potential risk of new and existing chemical substances and develop data 
    bearing on such risks.
        In accordance with 40 CFR 2.306(j), EPA has determined that under 
    EPA contract number 68-W6-0022, ERG, SAIC, MAT, and ICF will require 
    access to CBI submitted to EPA under sections 4, 5, 6, and 8 of TSCA to 
    perform successfully the duties specified under the contract. ERG, 
    SAIC, MAT, and ICF personnel will be given access to information 
    submitted to EPA under sections 4, 5, 6, and 8 of TSCA. Some of the 
    information may be claimed or determined to be CBI.
        In a previous notice published in the Federal Register of January 
    11, 1991 (56 FR 1185; FRL-3843-2), ERG was authorized access to CBI 
    submitted to EPA under sections 4, 5, 6, 8, 9, and 21 of TSCA under 
    contract number 68-D0-0020. EPA is issuing this notice to allow ERG, to 
    continue its works under the new contract number 68-W6-0022 and to 
    allow TSCA CBI access for the new subcontractors SAIC, MAT, and ICF.
        EPA is issuing this notice to inform all submitters of information 
    under sections 4, 5, 6, and 8 of TSCA that EPA may provide ERG, SAIC, 
    MAT, and ICF access to these CBI materials on a need-to-know basis 
    only. All access to TSCA CBI under this contract will take place at 
    ERG's Lexington, MA facility; SAIC, MAT, and ICF will have access only 
    at EPA Headquarters.
        ERG will be authorized access to TSCA CBI at their facility under 
    the EPA TSCA Confidential Business Information Security Manual. Before 
    access to TSCA CBI is authorized at ERG's site, EPA will approve their 
    security certification statements and ensure that the facility is in 
    compliance with the manual. Upon completing review of the CBI 
    materials, ERG will return all transferred materials to EPA.
        Clearance for access to TSCA CBI under this contract may continue 
    until April 30, 2001.
        ERG, SAIC, MAT, and ICF personnel will be required to sign 
    nondisclosure agreements and will be briefed on appropriate security 
    procedures before they are permitted access to TSCA CBI.
