    ACTION: Final rule.

    SUMMARY: This final rule removes obsolete regulations that governed old 
    sections 720-726, Part B, Title VII, of the Public Health Service (PHS) 
    Act, which addressed the award of grants and loan guarantees and 
    interest subsidies for the construction of teaching facilities for 
    medical, dental, and other health personnel. The Health Professions 
    Education Extension Amendments of 1992, Pub. L. 102-408, repealed Part 
    B of Title VII, Public Health Service Act. Accordingly, the provisions 
    of 42 CFR Part 57, Subpart B, are obsolete.
    
    EFFECTIVE DATE: This regulation is effective December 13, 1996.

    SUPPLEMENTARY INFORMATION: The Health Professions Education Extension 
    Amendments of 1992, Pub. L. 102-408, repealed Part B of Title VII, 
    Public Health Service Act. Accordingly, the provisions of 42 CFR Part 
    57, Subpart B, are obsolete. Sections 57.101 through 57.112 and 
    Appendix A are removed from the Code of Federal Regulations.
        The Public Health Service strongly encourages all grant and 
    contract recipients to provide a smoke-free workplace and to promote 
    the non-use of all tobacco products. In addition, Pub.L. 103-227, the 
    Pro-Children Act of 1994, prohibits smoking in certain facilities (or, 
    in some cases, any portion of a facility) in which regular or routine 
    education, library, day care, health care or early childhood 
    development services are provided to children.
    
    Justification for Omitting Notice of Proposed Rulemaking
    
        Since this amendment is of a technical nature, the Secretary has 
    determined, pursuant to 5 U.S.C. 553 and departmental policy, that it 
    is unnecessary and impractical to follow proposed rulemaking procedures 
    or to delay the effective date of these regulations.
    
    Economic Impact
    
        Executive Order 12866 requires that all regulations reflect 
    consideration of alternatives, of costs, of benefits, of incentives, of 
    equity, and of available information. Regulations must meet certain 
    standards, such as avoiding unnecessary burden. Regulations which are 
    ``significant'' because of cost, adverse effects on the economy, 
    inconsistency with other agency actions, effects on the budget, or 
    novel legal or policy issues, require special analysis.
        The Department believes that the resources required to implement 
    the requirements in this regulation are minimal. Therefore, in 
    accordance with the Regulatory Flexibility Act of 1980, the Secretary 
    certifies that this regulation will not have a significant impact on a 
    substantial number of small entities. For the same reasons, the 
    Secretary has also determined that this is not a ``significant'' rule 
    under Executive Order 12866.
    
    Paperwork Reduction Act of 1980
    
        This final rule contains no information collection or reporting 
    requirements which are subject to review by the Office of Management 
    and Budget (OMB) under the Paperwork Reduction Act of 1980.
