FEDERAL MINE SAFETY AND HEALTH REVIEW COMMISSION

items, the Commission will consider and act upon the following:

    2. Peabody Coal Co., Docket No. KENT 93-318-R, etc. (Issues 
include whether the judge erred in determining that the violations 
of 30 C.F.R. Sec. 70.100(a) were caused by Peabody's unwarrantable 
failure.)
    No earlier announcement of the addition to the agenda was 
possible.
