Texaco Refining and Marketing Inc. v. SFPP, L.P.; Notice of
Complaint
December 18, 1995.
Take notice that on December 1, 1995, Texaco Refining and Marketing
Inc. (Texaco) filed a complaint pursuant to sections 8, 9, 13(1), and
15(1) of the Interstate Commerce Act (ICA) and Rule 206 of the
Commission's Rules of Practice and Procedure against SFPP, L.P. (SFPP)
in the above captioned docket.
The complaint alleges that SFPP has violated and continues to
violate the ICA, including but not limited to Sections 1(5)(a), 2,
3(1), 6 and 8 by transporting refined petroleum products in interstate
commerce without having a tariff on file with the FERC, by charging an
unjust and unreasonable rate for the transportation of refined
petroleum products, by granting an undue discrimination and preference
to other shippers, and by charging more than the maximum filed rate for
transportation in interstate commerce from California origins to
destinations in California and Arizona. Texaco requests that the
Commission order such refunds as are deemed appropriate, and establish
lawful rates, terms and conditions for the transportation of refined
petroleum products in interstate commerce. Texaco further requests such
damages as the Commission finds appropriate, and interest and
attorney's fees.
Any person desiring to be heard or to protest the instant complaint
should file a motion to intervene or protest with the Federal Energy
Regulatory Commission, 888 First Street NE., Washington, DC 20426, in
accordance with Rules 214 and 211 of the Commission's Rules of Practice
and Procedure. All such motions or protests should be filed on or
before January 17, 1996. Protests will be considered by the Commission
in determining the appropriate action to be taken, but will not serve
to make protestants parties to the proceeding. Any person wishing to
become a party must file a motion to intervene. Copies of this filing
are on file with the Commission and are available for public
inspection. Answers to this complaint are due on or before January 17,
1996.
