Regional Offices; Jurisdictional Changes
AGENCY: Federal Labor Relations Authority (the Authority and the
General Counsel of the Federal Labor Relations Authority).
ACTION: Amendment of rules and regulations.

SUMMARY: This document amends the rules and regulations of the
Authority and the General Counsel of the Federal Labor Relations
Authority to provide for changes in the geographical jurisdictions of
the seven Regional Directors concerning unfair labor practice charges
and representation petitions.

SUPPLEMENTARY INFORMATION: Effective January 28, 1980, the Authority
and the General Counsel published, at 45 FR 3482, January 17, 1980,
final rules and regulations to govern the processing of cases by the
Authority and the General Counsel under chapter 71 of title 5 of the
United States Code. These rules and regulations are required by title
VII of the Civil Service Reform Act of 1978 and are set forth in 5 CFR
Part 2400 et seq. (1996).
Appendix A, paragraph (d) of the rules and regulations sets forth
the current addresses, telephone and fax numbers of the Regional
Offices of the Authority. This paragraph has been updated to reflect
the relocation of the Washington, DC Regional Office in December 1998.
Appendix A, paragraph (f) of the rules and regulations sets forth
the geographic jurisdictions of the Regional Directors of the Federal
Labor Relations Authority. In the best interest of maximizing the
resources of the Office of the General Counsel and efficient and
effective case processing, the General Counsel is realigning the
geographical jurisdictions of the Regional Directors to distribute the
caseload, based on a current analysis of case intake and available
resources in order to meet the needs of its customers. The resulting
change will result in equalizing the work for each regional office
employee. The Office of the General Counsel will continue to transfer
cases between regions on a recurring basis, as necessary, based on
caseload and staffing in order to maximize its resources.
Regulatory Flexibility Act Certification
Pursuant to section 605(b) of the Regulatory Flexibility Act, 5
U.S.C. 605(b), the Federal Labor Relations Authority has determined
that these regulations, as amended, will not have a significant
economic impact on a substantial number of small entities, because this
rule applies to federal employees, federal agencies, and labor
organizations representing federal employees.
Unfunded Mandates Reform Act of 1995
This rule change will not result in the expenditure by state,
local, and tribal governments, in the aggregate, or by the private
sector, of $100,000,000 or more in any one year, and it will not
significantly or uniquely affect small governments. Therefore, no
actions were deemed necessary under the provisions of the Unfunded
Mandates Act of 1995.
Small Business Regulatory Enforcement Fairness Act of 1996
This rule is not a major rule as defined by section 804 of the
Small Business Regulatory Enforcement Fairness Act of 1966. This rule
will not result in an annual effect on the economy of $100,000,000 or
more; a major increase in costs or prices; or significant adverse
effects on competition, employment, investment, productivity,
innovation or on the ability of United States-based companies to
compete with foreign-based companies in domestic and export markets.
Paperwork Reduction Act of 1995
This regulation contains no information collection or record
keeping requirement under the Paperwork Reduction Act of 1995 (44
U.S.C. 3507 et seq.)
For the reasons set out in the preamble and under the authority of
5 U.S.C. 7134, Appendix A to 5 CFR Chapter XIV is amended by revising
paragraph (d)(2) and paragraph (f) to read as follows:
