ACTION:
Final rule; correction.
SUMMARY:
The Department of Education is correcting a final regulation that was published in the Federal Register on October 29, 2008 (73 FR 64436). The final regulations clarified and strengthened the Title I regulations in the areas of assessment, accountability, public school choice, and supplemental educational services.

Effective December 23, 2008.

Accordingly, 34 CFR part 200 is corrected by making the following correcting amendments:

End Part Start Amendment Part1. The authority citation for part 200 continues to read as follows:
End Amendment Part[Amended]2. Section 200.7 is amended by:
End Amendment Part Start Amendment PartA. In paragraph (b)(3), removing the words “adequate yearly progress” and adding, in their place, the word “AYP”.
End Amendment Part Start Amendment PartB. In paragraph (b)(4), removing the words “adequate yearly progress” and adding, in their place, the word “AYP”.
End Amendment Part Start Amendment Part3. Section 200.12(a)(2) is amended by removing the words “adequate yearly progress” and the parentheses around the word “AYP”.
End Amendment Part Start Amendment Part4. Section 200.42 is amended by adding a new paragraph (b)(5) to read as follows:
