    SUMMARY:

    The Food Safety and Inspection Service (FSIS) is reopening the comment period for its proposed rule on the descriptive designation of needle- or blade-tenderized (mechanically tenderized) beef products that appeared in the Federal Register on June 10, 2013. FSIS is reopening this comment period for 21 days because the extended comment period on this proposed rule closed during the recent partial Government shutdown.

    SUPPLEMENTARY INFORMATION:

    On June 10, 2013, FSIS published a notice of proposed rulemaking in the Federal Register, “Descriptive Designation for Needle- or blade-tenderized (Mechanically Tenderized) Beef Products” (78 FR 34589). The Agency proposed to require the use of the descriptive designation “mechanically tenderized” on the labels of raw or partially cooked needle- or blade-tenderized beef products, including beef products injected with marinade or solution, unless these products are to be fully cooked at an official establishment. The Agency proposed to require that the product name for the beef products include the descriptive designation “mechanically tenderized” and an accurate description of the beef component. The Agency also proposed to require that the print for all words in the product name appear in the same style, color, and size and on a single-color contrasting background.

    In addition, FSIS proposed to require that the labels of raw and partially cooked needle- or blade-tenderized beef products destined for household consumers, hotels, restaurants, or similar institutions include validated cooking instructions.

    FSIS also announced that it had posted on its Web site guidance for developing validated cooking instructions for mechanically tenderized product.

    In response to requests from trade associations for additional time to provide comments, FSIS extended the original comment period until October 8, 2013 (78 FR 48631; Aug. 9, 2013). However, October 8, 2013, fell during the partial Government shutdown that occurred from October 1 to October 16. During this period, Agency personnel were unavailable to respond to public inquiries concerning the proposal, to file public comments in the administrative record for the rulemaking, or to upload comments to the regulations.gov Web page. Therefore, to provide the public with a full opportunity to comment on the proposed rule and associated guidance document, FSIS has decided to reopen the comment period until December 24, 2013. FSIS invites interested persons to submit their comments by that date.
