Proposed Revision of Class E Airspace; Hondo, TX
AGENCY: Federal Aviation Administration (FAA), DOT.
ACTION: Supplemental notice of proposed rulemaking (SNPRM); reopening
of comment period.

SUMMARY: This document revises an earlier proposed airspace rule that
would have amended the airspace at Hondo, TX. That proposal was
preempted by the development of a new very high frequency omni-
directional range (VOR) standard instrument approach procedure (SIAP)
to Runway (RWY) 17. The legal description of the proposed airspace in
the notice of proposed rulemaking was incomplete. The intended effect
of this proposal is to provide adequate controlled airspace for
aircraft executing the recently established VOR RWY 17 SIAP at Hondo,
TX.

Comments Invited
Interested parties are invited to participate in this proposed
rulemaking by submitting such written data, views, or arguments as they
may desire. Comments that provide the factual basis supporting the
views and suggestions presented are particularly helpful in developing
reasoned regulatory decisions on the proposal. Comments are
specifically invited on the overall regulatory, aeronautical, economic,
environmental, and energy-related aspects of the proposal.
Communications should identify the airspace docket number and be
submitted in triplicate to the address listed under the caption
ADDRESSES. Commenters wishing the FAA to acknowledge receipt of their
comments on this notice must submit, with those comments, a self-
addressed, stamped, postcard containing the following statement:
``Comments to Airspace Docket No. 92-ASW-34.'' The postcard will be
date and time stamped and returned to the commenter. All communications
received on or before the specified closing date for comments will be
considered before taking action on the proposed rule. The proposals
contained in this notice may be changed in the light of comments
received. All comments submitted will be available for examination in
the Office of the Assistant Chief Counsel, 2601 Meacham Boulevard, Room
663, Fort Worth, TX, both before and after the closing date for
comments. A report summarizing each substantive public contact with FAA
personnel concerned with this rulemaking will be filed in the docket.
Availability of SNPRM
Any person may obtain a copy of this SNPRM by submitting a request
to the Federal Aviation Administration, System Management Branch,
Department of Transportation, Fort Worth, TX 76193-0530. Communications
must identify the notice number of this SNPRM. Persons interested in
being placed on a mailing list for future NPRM's should also request a
copy of Advisory Circular No. 11-2A that describes the application
procedure.
The Proposal
On December 17, 1993, the FAA proposed to revise the Class E
airspace at Hondo, TX (58 FR 65948). That action proposed to revise the
700 feet AGL Class E airspace to provide adequate controlled airspace
for aircraft executing the recently established VOR SIAP to RWY 17. The
comment period for that action ended February 19, 1994. Since the
issuance of that Notice of Proposed Rulemaking (NPRM), the FAA has
discovered that the legal description contained in that proposal did
not include the airspace required from the airport to 16 miles south of
RBN. Therefore, this SNPRM proposes a correction to that legal
description. Since this change expands the scope of the originally
proposed rule, the FAA has determined that it is necessary to reopen
the comment period to provide an additional opportunity for public
comment.
The coordinates for this airspace docket are based on North
American Datum 83. Designated Class E airspace areas extending upward
from 700 feet or more above ground level are published in Paragraph
6005 of FAA Order 7400.9B dated July 18, 1994, and effective September
16, 1994, which is incorporated by reference in 14 CFR 71.1. The Class
E airspace designation listed in this document would be published
subsequently in the order.
The FAA has determined that this proposed regulation only involves
an established body of technical regulations that need frequent and
routine amendments to keep them operationally current. It, therefore--
(1) is not a ``significant regulatory action'' under Executive Order
12866; (2) is not a ``significant rule'' under DOT Regulatory Policies
and Procedures (44 FR 11034; February 26, 1979); and (3) does not
warrant preparation of a regulatory evaluation as the anticipated
impact is so minimal. Since this is a routine matter that will only
affect air traffic procedures and air navigation, it is certified that
this rule, when promulgated, will not have a significant impact on a
substantial number of small entities under the criteria of the
Regulatory Flexibility Act.

Administration proposes to amend 14 CFR part 71 as follows:

miles west and 4 miles east of the 180' bearing from the Hondo RBN
extending from the airport to 16 miles south of the RBN and within
2.3 miles each side of the 352 deg. radial of the Hondo VOR
extending from the 6.7-mile radius to 6.9 miles north of the
airport.
