Intrastate Rail Rate Authority--West Virginia

AGENCY: Interstate Commerce Commission.

ACTION: Notice of provisional recertification.

SUMMARY: The State of West Virginia has filed an application for 
recertification. The Commission, under State Intrastate Rail Rate 
Authority, 5 I.C.C.2d 680, 685 (1989) (Authority), provisionally 
recertifies the State of West Virginia to regulate intrastate rail 
rates, classifications, rules, and practices. After its review, the 
Commission will issue a recertification decision or take other 
appropriate action.

DATES: This provisional recertification was effective on the date the 
application for recertification was filed with the Commission.
