Approval and Promulgation of Implementation Plans and Delegation
of 112(l) Authority; Lincoln-Lancaster County Health Department and
City of Omaha (Nebraska)
AGENCY: Environmental Protection Agency (EPA).
ACTION: Proposed rule.

SUMMARY: The EPA proposes to approve the State Implementation Plan
(SIP) revision submitted by the state of Nebraska on behalf of the two
local air pollution control agencies. The state has an approved program
(published in the Federal Register on January 4, 1995), and the local
agencies have adopted the state's regulatory framework. The state has
made this request so that the local agencies may issue Federally
enforceable Class II permits as an alternative to Title V.
Like the state's program, this SIP revision includes the creation
of a Class II operating permit program and adopts the state's Part D
(nonattainment) new source review rule changes, SO2 rule
corrections, and provisions for compliance and enforcement information.
In the final rules section of the Federal Register, the EPA is
approving this revision as a direct final rule without prior proposal
because the Agency views this as a noncontroversial revision amendment
and anticipates no adverse comments. A detailed rationale for the
approval is set forth in the direct final rule.
If no adverse comments are received in response to this proposed
rule, no further activity is contemplated in relation to this rule. If
the EPA receives adverse comments, the direct final rule will be
withdrawn, and all public comments received will be addressed in a
subsequent final rule based on this proposed rule. The EPA will not
institute a second comment period on this document. Any parties
interested in commenting on this document should do so at this time.
