FEDERAL MINE SAFETY AND HEALTH REVIEW COMMISSION

TIME AND DATE: 10 a.m., Thursday, February 17, 1994.

STATUS: Closed [Pursuant to 5 U.S.C. Sec. 552b(c)(10)].

MATTERS TO BE CONSIDERED: In addition to the previously announced item, 
the Commission will consider and act upon the following:

    1. Secretary of Labor v. Prabhu Deshetty, Docket No KENT 92-549. 
(Issues include whether the judge erred in finding that Mr. Deshetty 
knowingly authorized, ordered, or carried out a violation of 30 CFR 
75.400 within the meaning of 30 U.S.C. Sec. 820(c).)

    It was determined by the Commission that this item be included 
on the agenda in closed session and that no earlier announcement of 
the addition of this matter to the previously scheduled meeting was 
possible.
