Preparing No-Migration Demonstrations for Municipal Solid Waste
Disposal Facilities--A Screening Tool
AGENCY: Environmental Protection Agency (EPA).
ACTION: Notice.

SUMMARY: The Environmental Protection Agency (EPA) is issuing a
guidance document that will assist owners and operators of Municipal
Solid Waste Landfills (MSWLFs) in deciding whether to consider making a
no-migration demonstration (NMD). EPA regulations (40 CFR part 258) for
MSWLFs allow groundwater monitoring requirements to be suspended by the
Director of an Approved State if there is no potential for migration of
hazardous constituents from the unit to the uppermost aquifer during
the active life and post-closure care period.
A NMD can provide a cost effective alternative for owners and
operators of MSWLFs in specific climatic and hydrogeologic conditions
to comply with the groundwater monitoring provisions of EPA's rules.
NMDs are designed to result in the same environmental protection at
less cost to the owner or operator.
The Agency prepared this guidance at the direction of the Land
Disposal Program Flexibility Act (LDPFA) which required EPA to issue a
guidance document to facilitate the use of NMDs by small MSWLFs. Thus,
the primary audience for the draft guidance manual is owners and
operators of small MSWLFs; however, the general approach would be
useful to an owner or operator of any size MSWLF.
