The Commission will consider and act upon the following in open session: Secretary of Labor v. Premier Elkhorn Coal Company, Docket No. KENT 2011-827, and Secretary of Labor v. Trivette Trucking, Docket No. KENT 2011-1223. (Issues include whether the Judge erred in vacating a citation alleging that a truck driver had failed to maintain control of his truck and in excluding certain evidence from the record.)
