Notice of Lodging Consent Decree Pursuant to the Clean Water Act
In accordance with Departmental Policy, 28 CFR 50.7, notice is
hereby given that a consent decree in United States v. Sheridan Area
Water Supply Joint Powers Board (D. Wyo.), was lodged with the United
States District Court for the District of Wyoming on February 5, 1999.
This Consent Decree concerns a complaint filed by the United States
against Sheridan Area Water Supply Joint Powers Board, Barcon, Inc. and
Fisher Sand and Gravel Co., Inc., pursuant to section 309 of the Clean
Water Act, 33 U.S.C. Sec. 1319, to obtain injunctive relief and impose
civil penalties upon the Defendants for discharge of dredged or fill
material in violation of CWA section 301(a), 33 U.S.C. Sec. 1311(a).
The Consent Decree prohibits additional illegal discharges by the
Defendants, and requires appropriate injunctive relief and the payment
of civil penalties.
The Department of Justice will accept written comments relating to
this proposed Consent Decree for thirty (30) days from the date of
publication of this notice. Please address comments to Carol A.
