Drawbridge Operation Regulations; Nueces Bay, TX
AGENCY: Coast Guard, DOT.
ACTION: Final rule; removal.

SUMMARY: This amendment removes the regulation for the US Highway 181
drawbridge across Neuces Bay, mile 0.5, at Corpus Christi, Texas,
because a fixed span replacement bridge has been constructed and the
drawspan bridge has been removed. Notice and public procedure have been
omitted from this action because the drawspan bridge is no longer in
existence.

SUPPLEMENTARY INFORMATION: This action has no economic consequences. It
merely removes a regulation that is unnecessary because the regulated
drawbrige no longer exists. Consequently, this action is considered to
be non-major under Executive Order 12866 and is not significant under
the Department of Transportation Regulatory Policies and Procedures (44
FR 11034, February 26, 1979). Since there is no economic impact, a full
regulatory evaluation is unnecessary. Because no notice of proposed
rulemaking is required under 5 U.S.C. 553, this action is exempt from
the Regulatory Flexibility Act (5 U.S.C. 605(b)). This action will not
have a significant economic impact on a substantial number of small
entities.

Federalism: This action has been analyzed in accordance with the
principles and criteria contained in Executive Order 12612, and it has
been determined that this action does not have sufficient federalism
implications to warrant the preparation of a Federalism Assessment.
