Notice of Lodging of Stipulation and Settlement Under the Clean
Water Act
In accordance with Departmental policy, 28 CFR Sec. 50.7, notice is
hereby given that a proposed Stipulation and Settlement in U.S. v.
Caribe Tuna, Inc., Civ. No. 91-1926 (D.P.R.), was lodged on March 13,
1996 with the United States District Court for the District of Puerto
Rico. The complaint in this action seeks injunctive relief and civil
penalties under Section 301 of the Clean Water Act (``the Act''), 33
U.S.C. 1311, in connection with Caribe Tuna, Inc.'s (``CTI'') operation
of a tuna processing plant located in Ponce, Puerto Rico.
The proposed Stipulation and Settlement provides for CTI to pay a
civil penalty to the United States of $300,000.
The Department of Justice will receive, for a period of thirty (30)
days from the date of this publication, comments relating to the
proposed Stipulation and Settlement. Comments should be addressed to
the Assistant Attorney General for the Environment and Natural
Resources Division, Department of Justice, P.O. Box 7611, Ben Franklin
Station, Washington, D.C. 20044-7611, and should refer to U.S. v.
Caribe Tuna, Inc., DOJ Ref. No. 90-5-1-3638.
The proposed consent decree may be examined at the Office of the

(202) 624-0892. A copy of the proposed consent decree may be obtained
in person or by mail from the Consent Decree Library, 1120 G. Street,
Fourth Floor, N.W. Washington D.C. 20005. In requesting a copy, please
refer to the referenced case and enclose a check in the amount of $2.00
(25 cents per page reproduction costs), payable to the Consent Decree
Library.
