SUMMARY: This notice proposes to amend the Class E airspace areas at,
Lawrence, KS; Perryville, MO; Warrensburg, MO; Burlington, IA; Des
Moines, IA; Fort Madison, IA and Dubuque, IA. A review of the Class E
airspace designations for the airports listed above indicates they do
not meet the criteria for 700 feet Above Ground Level (AGL) airspace
required for diverse departures as specified in FAA Order 7400.2D. The
areas are enlarged to conform to the criteria of FAA Order 7400.2D. The
Airport Reference Points (ARP) for Perryville, MO, and Des Moines, IA,
are amended. The Instrument Landing System (ILS) and coordinates have
been added to the airspace designation for Des Moines, IA. The intended
effect of this rule is to comply with the criteria of FAA Order
7400.2D, amend the appropriate ARPs, add the ILSs and coordinates, and
provide additional controlled Class E airspace for aircraft operating
under Instrument Flight Rules.

rulemaking by submitting such written data, views, or arguments as they
may desire. Comments that provide the factual basis supporting the
views and suggestions presented are particularly helpful in developing
reasoned regulatory decisions on the proposal. Comments are
specifically invited on the overall regulatory. economic,
environmental, and energy-related aspects of the proposal.
Communications should identify the airspace docket number and be
submitted in triplicate to the address listed above. Comments wishing
the FAA to acknowledge receipt of their comments on this notice must
submit with those comments a self-addressed, stamped postcard on which
the following statement is made: ``Comments to Airspace Docket No. 98-
ACE-14'' The postcard will be date/time stamped and returned to the
commenter. All communications received on or before the closing date
for comments will be considered before taking action on the proposed
rule. The proposal contained in this notice may be changed in light of
comments received. All comments submitted will be available for
examination in the Rules Docket both before and after the closing date
for comments. A report summarizing each substantive public contact with
FAA personnel concerned with this rulemaking will be filed in the
docket.

The Proposal
The FAA is considering an amendment to 14 CFR 71 to amend the Class
E airspace areas at Lawrence Municipal Airport, KS; Perryville
Municipal Airport, MO; Warrensburg Skyhaven Aiport, MO; Burlington
Municipal Airport, IA; Des Moines International Airport, IA; Fort
Madison Municipal Airport, IA; and Dubuque Regional Airport, IA. A
review of the Class E airspace designations for these airports
indicates they do not meet the criteria for 700 feet AGL airspace
required for diverse departures as specified in FAA Order 7400.2D. The
criteria in FAA Order 7400.2D for an aircraft to reach 1200 feet AGL,
is based on a standard climb gradient of 200 feet per mile, plus the
distance from the Airport Reference Point (ARP) to the end of the
outermost runway. Any fractional part of a mile is converted to next
higher tenth of a mile. The amendment of Class E airspace for the
airports listed above will meet the criteria of FAA Order 7400.2D,
amend the appropriate ARPs, add the ILS and coordinates, provide
additional controlled airspace at and above 700 feet AGL, and thereby
facilitate separation of aircraft operating under Instrument Flight
Rules. The areas will be depicted on appropriate aeronautical charts.
Class E airspace areas extending upward from 700 feet or more above the
surface of the earth are published in paragraph 6005 of FAA Order
7400.9E, dated September 10, 1997, and effective September 16, 1997,
which is incorporated by reference in 14 CFR 71.1. The Class E airspace
designations listed in this document will be published subsequently in
the Order.
The FAA has determined that this proposed regulation only involves
an established body of technical regulations for which frequent and
routine amendments are necessary to keep them operationally current.
Therefore, this proposed regulation (1) is not a ``significant
regulatory action'' under Executive Order 12866; (2) is not a
``significant rule'' under DOT Regulatory Policies and Procedures (44
FR 11034; February 26, 1979); and (3) does not warrant preparation of a
Regulatory Evaluation as the anticipated impact is so minimal. Since
this is a routine matter that will only affect air traffic procedures
and air navigation, it is certified that this proposed rule will not
have a significant economic impact on a substantial number of small
entities under the criteria of the Regulatory Flexibility Act.
