Calcium Aluminate Cement and Cement Clinker From France; Notice
of Commission Determination To Conduct a Portion of the Hearing in
Camera
AGENCY: U.S. International Trade Commission.
ACTION: Closure of a portion of a Commission hearing to the public.

SUMMARY: Upon request of the parties in the above-captioned final
investigation, the Commission has unanimously determined to conduct a
portion of its hearing scheduled for March 31, 1994, in camera. See
Commission rules 207.23(a), 201.13 and 201.35(b)(3) (19 CFR 207.23(a),
201.13 and 201.35(b)(3)). The remainder of the hearing will be open to
the public. The Commission unanimously has determined that the 7-day
advance notice of the change to a meeting was not possible. See
Commission rule 201.35(a), (c)(1) (19 CFR 201.35(a), (c)(1)).

SUPPLEMENTARY INFORMATION: The Commission believes that good cause
exists in this investigation to hold a short portion of the hearing in
camera. The majority of the information collected by the Commission is
business proprietary information (BPI) because there are two domestic
firms and one foreign producer. The in camera portions of the hearing
will be for the purpose of addressing BPI as part of the parties'
presentations-in-chief, and therefore is properly the subject of an in
camera hearing pursuant to Commission Rule 201.36(b)(4). See 19 CFR
201.36(b)(4). In making this decision, the Commission nevertheless
reaffirms its belief that wherever possible its business should be
conducted in public.
The hearing will include the usual public presentations by
petitioner and by respondent, with questions from the Commission. In
addition the hearing will include in camera sessions for short
presentations by petitioner and by respondents with questions from the
Commission of BPI submitted by the parties, as necessary. For the in
camera portions of the hearing, the room will be cleared of all persons
except: those who have been granted access to BPI under a Commission
administrative protective order (APO), and who are included on the
Commission's APO service list in this investigation. See 19 CFR
201.35(b)(1), (2). In addition, if petitioner's BPI will be discussed
in the in camera session, personnel of petitioner also may be granted
access to the closed session. See 19 CFR 201.35(b)(1), (2). In the
alternative, if respondent's BPI will be discussed in the in camera
session, personnel of respondent also may be granted access to the
closed session. See 19 CFR 201.35(b)(1), (2). All those planning to
attend the in camera portions of the hearing should be prepared to
present proper identification.
Authority: The General Counsel has certified, pursuant to
Commission Rule 201.39 (19 CFR 201.39) that, in her opinion, a
portion of the Commission's hearing in Certain Calcium Aluminate
Cement and Cement Clinker from France, Inv. No. 731-TA-645 (Final),
may be closed to the public to prevent the disclosure of business
proprietary information.
