Regulations and Rulings, Social Security Administration, 6401 Security
Boulevard, Baltimore, MD 21235, (410) 965-1711.
supplementary information: Social Security Rulings make available to
the public precedential decisions relating to the Federal old-age,
survivors, disability, supplemental security income, and black lung
benefits programs. Social Security Rulings may be based on case
decisions made at all administrative levels of adjudication, Federal
court decisions, Commissioner's decisions, opinions of the Office of
the General Counsel, and other policy interpretations of the law and
regulations.
SSR 76-28 and SSR 76-41 were published in the 1976-1980 Cumulative
Edition of the Rulings, and SSR 88-11c was published in the 1988
Cumulative Edition of the Rulings. These Rulings concern the definition
the Social Security Administration used for the term ``eligible
spouse'' in supplemental security income cases.
Section 8012 of Public Law (Pub. L.) 101-239 (the Omnibus Budget
Reconciliation Act of 1989) changed the definition of the term
``eligible spouse'' by eliminating the 6-month waiting period for
ending couple status after a separation. The definition of the term
``eligible spouse'' as used in these Rulings is no longer applicable
because of the revised statutory definition. We are publishing final
regulations to reflect section 8012 of Pub. L. 101-239 on this date.
