Decision List No. 24--Week of March 10 Through March 14, 1997
Appeals
Quivira Mining Company, 3/13/97, VEA-0007
[[Page 18114]]
Quivira Mining Company filed an Appeal from a determination of the
Environmental Restoration Division of the DOE's Albuquerque Operations
Office, disallowing certain remedial action costs claimed pursuant to
10 C.F.R. Part 765. Quivira contended that it was entitled to revise
its reported costs to claim (i) Depreciation on equipment that had
already been expensed or fully depreciated and (ii) home office
expenses that had been reallocated to the reclamation activities. The
DOE rejected the Appeal, finding that the firm had not demonstrated
that it was entitled to the claimed costs under the relevant statute
and implementing regulations.
