2021-07654. Petition for Waiver of Compliance

  • Start Preamble

Under part 211 of title 49 Code of Federal Regulations (CFR), this document provides the public notice that on March 8, 2021, Georgetown Loop Railroad (GLRX) petitioned the Federal Railroad Administration (FRA) for a waiver of compliance from certain provisions of the Federal railroad safety regulations contained at 49 CFR part 230, Steam Locomotive Inspection and Maintenance Standards. FRA assigned the petition Docket Number FRA-2021-0036.

Specifically, GLRX requests relief from 49 CFR 230.16(a)(2), Fifth annual inspection, of flexible staybolts and caps, for a period of one year for locomotive GLRX #111. The locomotive has operated for 375 service days since it entered service in 2016 with a newly constructed boiler. GLRX states that because of the coronavirus disease 2019, GLRX #111 did not incur any service days in 2020. If granted the requested relief, GLRX explains it would perform the required testing at the 2022 annual inspection.

A copy of the petition, as well as any written communications concerning the petition, is available for review online at www.regulations.gov.

Interested parties are invited to participate in these proceedings by submitting written views, data, or comments. FRA does not anticipate scheduling a public hearing in connection with these proceedings since the facts do not appear to warrant a hearing.
