Notice of proposed rulemaking.
SUMMARY:
This action proposes to establish new Class E airspace at Allakaket, AK. Two new Standard Instrument Approach Procedures (SIAP) and one new Textual Departure Procedure are being published for the Allakaket Airport. Adoption of this proposal would result in the establishment of Class E airspace upward from 700 feet (ft.) and 1200 ft. above the surface at Allakaket, AK.

Interested parties are invited to participate in this proposed rulemaking by submitting such written data, views, or arguments as they may desire. Comments that provide the factual basis supporting the views and suggestions presented are particularly helpful in developing reasoned regulatory decisions on the proposal. Comments are specifically invited on the overall regulatory, aeronautical, economic, environmental, and energy-related aspects of the proposal. Communications should identify both docket numbers and be submitted in triplicate to the address listed above. Commenters wishing the FAA to acknowledge receipt of their comments on this notice must submit with those comments a self-addressed, stamped postcard on which the following statement is made: “Comments to Docket No. FAA-2004-17496/Airspace Docket No. 04-AAL-4.” The postcard will be date/time stamped and returned to the commenter.

The Proposal
The FAA is considering an amendment to the Code of Federal Regulations (14 CFR Part 71) by establishing new Class E airspace at Allakaket, AK. The intended effect of this proposal is to establish Class E airspace upward from 700 ft. and 1,200 ft. above the surface, to contain Instrument Flight Rules (IFR) operations at Allakaket, AK.
The FAA Instrument Flight Procedures Production and Maintenance Branch has developed two new SIAPs for the Allakaket Airport. The new approaches are: (1) Area Navigation (Global Positioning System) ( RNAV GPS) Runway (RWY) 5, original; and (2) RNAV (GPS) Runway 23, original. A Textual Departure Procedure will also be established. New Class E controlled airspace extending upward from 700 ft. and 1,200 ft. above the surface within the Allakaket Airport area would be created by this action. The proposed airspace is sufficient to contain aircraft executing the new instrument procedures for the Allakaket Airport.
The area would be depicted on aeronautical charts for pilot reference. The coordinates for this airspace docket are based on North American Datum 83. The Class E airspace areas designated as 700/1200 foot transition areas are published in paragraph 6005 in FAA Order 7400.9L, Airspace Designations and Reporting Points, dated September 2, 2003, and effective September 16, 2003, which is incorporated by reference in 14 CFR 71.1. The Class E airspace designations listed in this document would be published subsequently in the Order.
The FAA has determined that this proposed regulation only involves an established body of technical regulations for which frequent and routine amendments are necessary to keep them operationally current. It, therefore—(1) Is not a “significant regulatory action” under Executive Order 12866; (2) is not a “significant rule” under DOT Regulatory Policies and Procedures (44 FR 11034; February 26, 1979); and (3) does not warrant preparation of a regulatory evaluation as the anticipated impact is so minimal. Since this is a routine matter that will only affect air traffic procedures and air navigation, it is certified that this rule, when promulgated, will not have a significant economic impact on a substantial number of small entities under the criteria of the Regulatory Flexibility Act.
